QUESTION PRESENTED
Whether the Equal Protection Clause of the Fourteenth Amendment prohibits the State of California from defining marriage as the union of a man and a woman.

Prop. 8 supporters (who are you and why won’t you leave us alone?) have filed their petition for writ of certiorari in the Supreme Court.  At issue is the 9th Circuit’s holding that the voter-enacted anti-same-sex marriage proposition is unconstitutional under the Equal Protection Clause of the 14th Amendment.  This could be one of the first cases to reach the Supremes where they will actually touch on the equal protection in the context of gay marriage.
